Spreading festive cheer – The tax-friendly way to give at Christmas

As the festive season approaches, many employers look for thoughtful ways to show employee appreciation.

A box of chocolates for the office administrator and a bottle of wine for the team manager – these small gestures can greatly impact morale.

However, before you start shopping, it is important to consider the tax implications of such gifts.

Thankfully, with some planning, you can keep the festive spirit alive without getting tangled in tax obligations.

By making use of trivial benefits, you can give meaningful gifts while staying tax-efficient.

What counts as a trivial benefit?

Trivial benefits are small perks or gifts given to employees that HM Revenue & Customs (HMRC) considers too minor to tax – provided they meet certain criteria.

For a gift to qualify as a trivial benefit, it must meet all the following conditions:

Common examples include flowers, seasonal treats like wine or hampers, or even tickets to a theatre show.

Why use trivial benefits?

The major appeal of trivial benefits lies in their tax efficiency.

If your gifts meet HMRC’s criteria, they are entirely exempt from tax and National Insurance Contributions (NICs).

There is no need to report them to HMRC, so you can skip the hassle of filing a P11D form.

However, if a gift exceeds the £50 limit or doesn’t meet one of the criteria, it loses its trivial status.

In these cases, it will need to be declared to HMRC, and you will need to account for any associated tax or NICs.

If you are processing benefits through payroll, filing a P11D form isn’t necessary, but a P11D(b) form may still be required to report Class 1A NICs.

Staying on the right side of the rules

Keeping good records will help to make sure your Christmas gifting remains tax-efficient.

For each gift, document the following:

Creating a dedicated expense category in your accounting system for trivial benefits can also help you stay organised and ensure your records are clear.
